These Terms of Service ("Terms") govern your use of kenospots.com and the tools, content, and accounts offered on it (the "Service"), operated by KenoSpots LLC ("KenoSpots," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
KenoSpots is an independent informational and entertainment resource for keno players. All content, including guides, calculators, odds, and payout figures, is provided for general information and entertainment. Nothing on the Service is gambling advice, financial advice, or a recommendation to place any wager. You are solely responsible for any decisions you make.
You cannot bet, wager, or win real money on KenoSpots. We do not sell lottery tickets, accept deposits, process bets, or pay out prizes. Any "play" features on the Service are free simulations for practice and entertainment and involve no real money and no real prizes. To play real keno, you must do so through a licensed lottery retailer or operator where it is legal, and you must meet the applicable age and eligibility requirements.
The Service is intended for adults. You must be at least 18 years old to use the Service, and at least 21 in jurisdictions where that is the minimum age for lottery or gaming activity. By using the Service, you represent and warrant that you meet these age requirements, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under the laws of your jurisdiction. Keno and lottery play may be restricted or illegal where you live; you are responsible for knowing and complying with the laws that apply to you.
The odds, probabilities, and payout figures shown on the Service are calculated from published paytable data and standard mathematical models for informational purposes. Paytables vary by jurisdiction and operator and can change without notice. We do not guarantee that any odds or payout figure is current, complete, or accurate for your specific game. Always verify current rules and payouts with the official lottery or operator before you play.
KenoSpots aggregates and presents publicly available lottery results and game information. We are an independent site and are not affiliated with, endorsed by, sponsored by, or connected to any state lottery commission, gaming operator, or casino. Lottery names and game names are the property of their respective owners and are used for identification and informational purposes only. Official results are determined solely by the relevant lottery; if our data and the official source differ, the official source controls.
Some features let you create an account, for example to save numbers across devices. You are responsible for maintaining the confidentiality of your account and for activity that occurs under it. You agree to provide accurate information and to use the account only for lawful, personal, non-commercial purposes. You must be at least 18 years old to create an account. We may suspend or terminate accounts that violate these Terms or that are used for abuse, fraud, or unlawful activity.
Numbers you save, favorites you set, and similar inputs ("Your Content") remain yours. By using the Service, you grant us a limited license to store and process Your Content solely to provide the features you use, such as saving and syncing your numbers. You are responsible for keeping your own copies of anything important to you. We are not liable for loss of saved numbers stored in your browser, for example if you clear your browser data.
If you send us ideas, suggestions, bug reports, or other feedback about the Service, you agree that we may use it without restriction or compensation to you, and that it is provided on a non-confidential basis. You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, copy, modify, and incorporate your feedback into the Service for any purpose. This does not give us ownership of Your Content as defined above.
You agree not to misuse the Service. Among other things, you may not: attempt to disrupt or overload the Service; scrape or harvest data in a manner that burdens our infrastructure; reverse engineer or interfere with the Service's security; use the Service for any unlawful purpose; or copy or redistribute our content in a way that infringes our rights.
The Service, including its design, text, graphics, logos, calculators, and original content, is owned by KenoSpots LLC or its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own informational and entertainment use. You may not reproduce, distribute, or create derivative works from our proprietary content without our prior written permission, except as permitted by law (such as brief quotation with attribution).
We respect intellectual property rights and expect users to do the same. If you believe content on the Service infringes your copyright, you may send a notice to legal@kenospots.com under the Digital Millennium Copyright Act (DMCA). Your notice should include: (1) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material you believe is infringing and enough information for us to locate it, such as a URL; (4) your contact information, including name, address, telephone number, and email; (5) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf. We will respond to valid notices, may remove or disable access to the material in question, and may terminate the accounts of repeat infringers. If you believe material was removed in error, you may submit a counter-notice with the same contact details.
The Service may link to third-party websites and resources. We provide these links for convenience and do not control or endorse those sites. We are not responsible for their content, accuracy, or practices, and your use of them is at your own risk and subject to their terms.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information, odds, or results shown will be accurate or reliable. Gambling involves financial risk, and the house edge in keno means players lose money over time. No information on the Service changes that.
To the fullest extent permitted by law, KenoSpots LLC and its owners, officers, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of or inability to use the Service, including any reliance on odds, payout figures, results, or other information. To the extent any liability cannot be excluded, our total liability for any claim relating to the Service is limited to one hundred US dollars (USD $100).
You agree to indemnify and hold harmless KenoSpots LLC from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or applicable law.
You may stop using the Service at any time, and you may delete your account by contacting us. We may suspend, restrict, or terminate your access to the Service or your account at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us, or used the Service in a way that harms other users or our infrastructure. We may also discontinue the Service, or any part of it, at any time. Sections of these Terms that by their nature should survive termination, including Intellectual Property, Saved Numbers and Your Content, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and the miscellaneous provisions below, will survive.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States and the state in which KenoSpots LLC is organized, without regard to conflict-of-law principles. Subject to the arbitration provision below, you and KenoSpots LLC agree that any dispute that is not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in that state, and you consent to personal jurisdiction there.
Informal resolution first. Before filing any claim, you agree to contact us at legal@kenospots.com and try to resolve the dispute informally for at least 30 days. Most concerns can be resolved this way.
Binding arbitration. To the fullest extent permitted by law, any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be settled by binding individual arbitration administered under the rules of a recognized arbitration body, rather than in court, except that either party may bring qualifying claims in small-claims court. The arbitration will take place in the state in which KenoSpots LLC is organized, or by remote means where available.
Class action waiver. You and KenoSpots LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Opt out. You may opt out of the arbitration and class-action-waiver provisions by emailing legal@kenospots.com within 30 days of first accepting these Terms, stating your name and your intent to opt out. Opting out does not affect any other part of these Terms. Nothing in this section limits rights you may have that cannot be waived under applicable law.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, make up the entire agreement between you and KenoSpots LLC regarding the Service and supersede any prior agreements on the subject. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these Terms without our consent, but we may assign them, for example in connection with a merger, acquisition, or sale of assets. We will not be liable for any delay or failure to perform caused by events beyond our reasonable control. If there is any conflict between these Terms and a specific notice posted for a particular feature, the specific notice controls for that feature. Section headings are for convenience only and do not affect interpretation.
